This assumes that students who are turned down by one private school will be able to find another one closeby enough that will accept them. Privates schools have a financial interest in being able to advertise themselves to parents as the best, which gives them an obligation to only accept students...

Private schools have the right to discriminate against what students to accept while public schools are under obligation to accept the students that private schools would turn away.
